Speeding Tickets and Infractions

Citations for speeding and other traffic offenses are common in Melbourne, Florida. Speeding tickets and other infractions are typically misdemeanor civil offenses. However, if a person does not get the citations adjudicated it is possible for serious penalties to result. Failure to adjudicate traffic citations can lead to arrest warrants, car impounding, huge fines and driver’s license suspension.

You need to contact a Melbourne traffic attorney right away if you have traffic citations. Most people incorrectly decide to plead no contest to the traffic citation instead of fighting the ticket. Speeding tickets stay on your driving record even after you pay them and can negatively affect your insurance rates. It is much better to have the ticket dismissed rather than have the tickets on your record.

Florida Traffic Violations Statutes

Under Section 316.187 of the Florida statutes, the Department of Transportation can set the speed zones of any highway or road connecting municipalities. The statute empowers the Department of Transportation to set reasonable and safe speed limits that will be effective when appropriate signs are erected at intersections and other parts of the highway. Here are the general guidelines that the Department of Transportation must follow when setting speed limits:

  • The maximum allowable speed limit on limited access highways is 70 miles per hour.
  • The maximum allowable speed limit on any other highway which is outside an area with a population of 5,000 people or more is set at 65 miles per hour.
  • In general, for other roadways it is advisable for the Department of Transportation not to exceed 60 miles per hour.

Violation of the speed limit is a moving violation punishable by a fine not to exceed $500.

Common Traffic Violation Points

Traffic violations create violation points that are added to your driving record. If you collect enough points, you might earn a habitual traffic offender classification which will severely reduce your driving privileges. Below are some common traffic violations along with the corresponding points:

3 Point Violations

  • Child restraint violation
  • Open container in the vehicle
  • Violation of curfew
  • Majority of moving violations
  • 15MPH or less over the lawful posted speed limit

4 Point Violations

  • 16MPH or more above the lawful posted speed limit
  • Passing a stopped school bus with lights flashing
  • Any moving violation resulting in an accident
  • Reckless driving

6 Point Violations

  • Leaving the scene of an accident with $50 or more worth of property damage
